Amendment of 07 July 2016 the Act on sports

On the 11 August 2016 an Act on sports passed on the 7 July 2016 (Journal of Laws 2016, item 1171) came into force.

The Amendment of the Act on sports introduces very significant changes in the Polish sports law in particular in terms of fighting doping.

Firstly, the legislator stated that Polish sport associations should be deprived of the right to establish the disciplinary rules relating doping in sport and conferred the exclusive competence in this scope to the Commission against Doping in Sport.
Secondly, the current definition of doping in sports that was introduced to the Act on sports fully complies with the definition of doping contained in the World Anti-Doping Code.
Thirdly, it was decided to exclude the use of art. 9a of the Act on sports in the disciplinary cases relating to doping. The above means that in the current legal status the Court of Arbitration for Sport at the Polish Olympic Committee in cases relating to doping issues awards on the basis of art. 13.2.2 of the Polish Anti-Doping Rules.
