We hereby inform that out of initiative of the Secretary of the Court of Arbitration for Sports at the Polish Olympic Committee – attorney Piotr R. Graczyk – on the 7 April 2017 the Council of the Court adopted a resolution in the subject of reducing the maximum fee paid by the party initiating the proceedings in the disciplinary case before the Court.
According to the adopted resolution of the Council of the Court the maximum fee in the disciplinary cases is currently 5.000,00 PLN instead of the previous amount of 7.500,00 PLN.
According to the art. 45c sec. 4 of the Act on sports of 25 June 2010 (Journal of Laws 2016, item 176) the amount of the fee for the complaint to the Court may not be higher than twice the amount of the average salary for the work in the national economy in the previous year announced by the President of the Central Statistical Office of Poland. According to the announcement of the President of the Central Statistical Office of Poland of the 9 February 2017 the average salary in the national economy was equal to 4.047,21 PLN. The amount of the fee for the complaint brought before the Court in the disciplinary case may amount to, under the Acts on sports, the maximum of 8.094,42 PLN.
At the same time we remind everyone that the fee in disciplinary cases is determined every time by the Secretary of the Court after the letter initiating the proceedings has been received.
The reduction of the fee is possible if the party filed an appropriate application and demonstrated the validity of the fee reduction through submitting documents presenting the financial, life and family situation of the applicant.
Pursuant to §5 sec. 3 of the Terms of Costs of the Court, in cases recognised by the Court parties and other participants to the proceedings are not eligible for full exemption from paying the Court costs – fee must be determined and paid in every case and material situation of the parties may be taken into consideration through modification of the amount of the fee.
According to the resolution of the Council of the Court of 10 April 2017 the minimum fee in the disciplinary cases amounts to 1.000,00 PLN.
